Tussle over taming the grandeur of the highest mountain range in the world for a commercial venture has reached the courtrooms. Aquifers nestled in Himalayas have been used by the Tata Group (previously Mount Everest Mineral Water Ltd.) and Bisleri International to source a premium segment of bottled water (enriched in minerals) as a launch-pad to hoist their international flags and towards a niche uber-urban segment.
The trouble brews in the fact that 'Himalaya' is a registered TradeMark with the Tatas. The counter argument of Bisleri states that 'Himalaya' is a generic name. Both parties accessed the provisions of the Indian Judicial System by raising their respective claims. More specifically, Ramesh Chauhan (chairman, Bisleri International) has sought cancellation of Tata's Himalaya brand through a rectification application filed with the Intellectual Appellate Board (IPAB), Chennai, based on the Geographical Indications Act which forbids the registration of a geographical name by a private company.
Statistics' disclosures maintain that 'Himalaya' brand mineral water, currently owned by the Tatas was bought over from Dadi Balsam (an NRI from Singapore) in 1991. The bottles formerly had horizontally located circumferential ridges and square cross-sectional bottles. Bisleri, on the other hand kicked off their premium segment edition in December, 2006. They have only recently accelerated their marketing of said product. Visually, the bottles are unribbed/unridged carrying a vertical label called 'Himalayan' (and in small descriptive font 'from the Himalayas').
While the matter was heard in courts on June 23rd and June 24th, 2008, an interim arrangement has been sought by both parties whereby, Bisleri has agreed to stop using the domain 'bislerihimalayan.com' It will continue to market water bottles that say 'from the Himalayas' as a descriptive mark in small font to denote the origin of the water. It has also agreed to inform its stockists about these arrangements. Come October, and a judgment will hopefully be doled out.

Crunching Business Parameters:
The numbers game disclosing current and potential marketing trends and statistics are the driving force for either party to assert their dominance, while it is the onus of the courts to simultaneously ensure a level playing field.
Currently pegged at Rs. 1000 - crore, the Indian bottled water industry is projected to grow @ 40% to touch Rs. 5000 - crore by 2010. The ingoing fight over establishing and protecting the identity of the premium bottled water segment is mainly to create an entry into foreign markets and thus define a global presence. e.g. exploiting the US market which is touted to touch US$ 50 billion.
Viewpoint:
Any registered TradeMark is designed with an aspect to provide the basis, thrust, and most importantly, to impart a unique identity to a commodity (product/service). Infringement of any registered TradeMark is substantiated when it is proved beyond reasonable doubt that the purported infringer has/is caused/causing confusion about the identity of the product, which ought to be protected by the registered TradeMark. Also, an infringement hints at the strength of the registered TradeMark in the market vis-à-vis its identification of the product and seemingly entices potential copiers to piggy-back on an already paved way of the 'recognised' commodity. An efficient judicial system enabled by strong laws and defined precedents need to be in place to thwart such 'piggy-backing' attempts.
A further objection could be raised wherein, the very identity of the product is threatened i.e. whether a mark/word(s) ought to be the subject matter in the first pace.
Apropos the bottled water industry, indicative graphs [1] clearly point out the increasing demand in a developing nation like India.
Primarily, for this reason, the cross-tracking attempts and attempts to create well-defined, non-confusing niches within the juxtaposed players of the same market, a non-generic identity mark is of paramount importance.
While it remains clear that 'Himalaya' is a generic name and a geographical location (and hence, not a subject matter of a TradeMark registration), it remains to be seen if its derivative factions such as 'Himalayan' or the like withstand the turbulence caused in respect of this case, and attract favourable judgment, thereto, thus egging other players to register such TradeMarks, and its plausible complications arising out of methods of distinction of such distinctive marks.

North Korea Missile Launch
North Korea is doing it’s wacky thing with the launch of a rocket they claim will send a communications satellite into space. The United States and some of it’s allies say this is a long-range ballistic missile test that violates U.N. policies. North Koreas likely cover up and unpredictable behavior has stirred the United Nations.
With North Koreas nuclear power it is troubling to nations within reach of North Korea’s missile launch. Japan is preparing ground forces with land-to-air missiles and interceptors they way will be used to shoot down any debris from the missile that may fall over the country. Patriot missiles have been deployed of the northern part of Japan.
The United States has two destroyers that left from South Korea to move closer to North Korea to monitor the launch. South Korea also is sending it’s destroyer to more closely monitor the North Korea activities.
North Korea made warnings to Japan stating that an attempt to intercept the missile will be viewed as an act of war. They also stated that they will use all military force necessary to stop any interceptors from destroying the missile.
Japan state that it does not intend to shoot the missile down but rather to defend it’s territory. This is confirmed in the fact that the missile has the range to carry a nuclear warhead to Japan and North Korea has several nuclear warheads.
The idea that a missile with the capability of carrying a nuclear warhead is being launched by a communist country is troubling for all democratic countries. North Korea has a past of troubling activity and is currently still giving any disruptments to their extreme behavior an extreme reaction.
There is talk that the North has the ability to make a smaller version of nuclear warheads that could be attached to Rodong missiles giving the missiles a much broader range. This information is unconfirmed but troubling at that.
North Korea has claimed that the US has had over 100 flights over the missile area and their territory. Now the North is threatening to shoot down any spy planes that enter their airspace to monitor the rocket launch. This was in reaction to this increase in spy flights by the US.
The North still is planning the missile test between April 4 through the 8th in which the United States says they can do nothing to stop it unless for some reason it looks like it is headed for Hawaii or somewhere threatening. North Korea has already moved the missile onto a launch pad and is preparing for it’s launch.
The current presidential administration has already headed towards the direction of scaling down a missile defense system that was started by President George W. Bush. In addition their is talk of lowering plans for a defense against missiles in Europe.
Futile attempts of diplomatic efforts have not stopped North Korea from it’s nuclear plans. Obama talks of increasing diplomatic relations with such tyrant countries is an unlikely strategy for success.

What is the maximum height this rocket will reach above the launch pad?
situation:A 7500-kg rocket blasts off vertically from the launch pad with a constant upward acceleration of 2.25 m/s2 and feels no appreciable air resistance. When it has reached a height of 525 m, its engines suddenly fail so that the only force acting on it is now gravity.
Step 1 -- to determine the velocity of the rocket when the engine failed. The working equation is
Vf^2 - Vo^2 = 2as
where
Vf = rocket velocity when the engine failed
Vo = initial velocity at launch pad = 0
a = 2.25 m/sec^2 (given)
s = distance travelled = 525 m (given)
Substituting appropriate values,
Vf^2 = 0 + 2(2.25)(525) = 2362.5
Vf = 48.60 m/sec.
Step 2 -- determine the distance that the rocket will continue to travel until it reaches its maximum height
The working formula is the same as in Step 1 except for the following designations:
Vf = 0 (since rocket will stop when it reaches its maximum height)
Vo = 48.60 m/sec (as determined in Step 1)
a = g = acceleration due to gravity = 9.8 m/sec^2 (constant)
s = maximum height (after 525 meters) at which rocket will travel
Substituting appropriate values,
0 - (48.60)^2 = 2(-9.8)s
NOTE the negative sign attached to the acceleration due to gravity. This simply implies that the rocket tends to slow down as it goes up after losing its engine power.
Solving for "s",
s = 48.60^2/(2 * 9.8)
s = 120.53 meters
Therefore, the maximum height that the rocket will reach above the launch pad is
525 + 120.53 = 645.53 meters
